Although the L-1B category is often used by software developers, engineers, and information technology professionals, it is not limited to the technology sector. Specialists from manufacturing, pharmaceuticals, biotechnology, finance, logistics, scientific research, and many other industries may also qualify if they possess unique knowledge that has particular value to the company.

Specialized knowledge may relate to proprietary software, internal business systems, manufacturing technologies, unique operational processes, research methodologies, or specialized company products and services.

To qualify for an L-1B visa, it is not necessary to be the inventor of a product or the creator of a technology. The primary requirement is that the applicant be able to demonstrate advanced and valuable knowledge of the company's operations, technologies, products, or internal processes that are necessary for the successful operation of the U.S. entity.


The foreign company must continue conducting business during the employee's transfer and must maintain a qualifying relationship with the U.S. company. The primary purpose of the L-1B visa is to transfer unique knowledge and expertise that will contribute to the growth and success of the business in the United States.

In certain cases, employees who initially enter the United States on an L-1B visa later move into managerial positions and may become eligible to change their status to the L-1A category.
